Planium Terms of Use

Welcome to Planium, a social app for planning activities with friends. These terms are a plain-language agreement between you and me — Mike Balvert (operating as "Softium"), an individual developer based in the Netherlands. Contact: mike@softium.nl, or see the support page.

They apply however you use Planium: the website, the installable web app, and the Planium app for iPhone.

By creating an account or using Planium, you agree to these terms. If you don't agree, please don't use the app.

1. Who can use Planium

• You must be at least 16 years old.
• You must provide a real email address that you control. You confirm it with a code Planium emails you; an account that is never verified is removed automatically.
• One account per person. Your account is personal — don't share your password, and don't use someone else's account.
• You are responsible for what happens through your account, so keep your password safe. If you think someone else has access, change your password (which logs out every device) and check Settings → Devices.

2. The service

Planium lets you create activities, invite friends, vote in polls, attach links and other add-ons to an activity, chat with participants, collect and place profile stickers, and organise the people you plan with into lists (private to you) and groups (shared with their members).

Planium is currently provided free of charge, with no purchases, subscriptions, or paid features, as a project built and run by one person. I work hard to keep it running well, but it is not backed by a company with an on-call team — see section 10 for what that means.

Your privacy matters: how your data is handled is described in the Privacy Policy, which is part of these terms.

3. Your content

Anything you post on Planium — messages, activity titles and descriptions, poll options, links you attach, group and list names, profile pictures, stickers — is your content and stays yours.

So that Planium can function, you give me permission to store, display, and transmit your content to the people it's meant for (for example, showing your message to the other participants of an activity chat, or your group's name to its members). This permission is only for operating the service, never for advertising or resale, and it ends when your content or account is deleted — except for limited copies kept for moderation and in backups, as described in the Privacy Policy.

Only upload content you have the right to use. Don't post other people's private information (addresses, phone numbers, photos of them) without their consent. Links you attach to an activity are your content too: you are responsible for where they lead.

4. Rules of conduct

Planium is for planning things with people you actually know. Keep it friendly. It is not allowed to use Planium to:

• harass, bully, threaten, or intimidate anyone;
• post hateful, discriminatory, or violent content — in messages, stickers, profile pictures, activity or poll text, or the name of a group;
• post sexual content involving minors (this will also be reported to authorities);
• post any content that is illegal in the Netherlands or in your country;
• impersonate another person;
• send spam, scams, or misleading links, or distribute malware — including through links attached to an activity;
• attempt to break into, overload, disrupt, or reverse-engineer the service, scrape it, or access other users' data;
• create accounts with automated tools, or use the service for commercial promotion.

These rules apply to everything you can name or write, including names you give to groups — a group name is visible to every member of that group.

5. Groups and lists

• A list is private to you: a saved way of grouping your own friend list, so you can invite several people at once. Nobody is told which list they are in, or that your lists exist.
• A group is shared. Every member sees the group, its name, and all other members — including members who are not your friends.
• You may only add your own friends to a group. Because whoever adds you is someone you already accepted, being added normally takes effect immediately. If you'd rather be asked first, turn on "Ask before adding me to groups" in your privacy settings and you'll receive an invite you can accept or decline.
• Membership is independent of friendship afterwards: unfriending or blocking the person who added you does not remove you from the group. You can leave any group at any time, and you can remove your own account's groups by deleting them as owner.
• Groups have an owner, who can hand ownership over, appoint admins, remove members, decide who may add members and who may rename the group, and delete the group for everyone. There are limits on how large a group can be and how many groups one account can create.

6. Reporting and blocking

• You can report a chat message or sticker via its long-press/context menu, report a user from their profile, and report a whole activity from its options menu — useful when the problem is the plan itself rather than one message. When you report, you pick a category (such as spam, harassment, hate, inappropriate content, or impersonation). Reports come directly to me and are reviewed manually. A snapshot of the reported message, or of the activity's title and host, is kept so it can be reviewed even if it is later edited or deleted. Reporting is anonymous to the person reported, and reporting an activity does not remove you from it — leave it separately if you want out.
• You can block another user. Blocking removes them from your friends, stops them from sending you new friend requests, and hides their messages, stickers, and other content from you in any activities or groups you still share (you can tap a hidden item to reveal it if you choose). Blocking does not remove someone from an activity or group you both already joined — if you would rather not share a space with a particular person, you can leave it.
• You can also report anything — including content outside of chat — by emailing mike@softium.nl or using the support page. Reports of illegal content are handled with priority.

7. Moderation and enforcement

Planium masks a small list of words in chat messages automatically, for everyone. It is a blunt word filter, not a judgement about you: it changes only what is displayed, never what you wrote, and it is no substitute for reporting something.

I review reports as quickly as I can, and aim to act on reports of objectionable content within 24 hours — by removing the content, and removing the user who posted it where that is warranted.

I may remove content and restrict, suspend, or terminate accounts that break these rules or the law. For serious violations (such as illegal content, harassment, or attacks on the service) this can happen immediately and without warning. Where reasonably possible, I will tell you what was removed and why, and you can object by replying to that message or emailing me.

There is no obligation to monitor content, and objectionable content may exist until it is reported — please use the report feature.

8. Ending your account

• You can leave at any time. Account deletion is available in the app under Settings → Profile → Delete account. When you delete your account, it is deactivated immediately, you receive a confirmation email, and it enters a 14-day grace period during which you can undo the deletion by logging back in and reactivating it. After 14 days, deletion is permanent — counting from your request, your account is gone within 2 weeks, one month at most. What happens to your data is described in the Privacy Policy.
• I can terminate accounts that violate these terms (section 7), or that are unverified/abandoned as described in the Privacy Policy's retention table.
• If Planium itself ever shuts down, you will be notified in advance with reasonable time to request a copy of your data.

9. The app, and updates

• The Planium app for iPhone is distributed through Apple's App Store, and installing or updating it is also subject to Apple's terms. It is free and contains no purchases.
• The app bundles a fixed version of Planium, so from time to time you have to update it to keep using it. When a version becomes too old to work safely with the servers, the app will show an update screen instead of starting, with a link to the App Store.
• The website and installed web app update themselves, so this never applies to them.
• You may not redistribute, repackage, or modify the app, or run it against the Planium servers from your own client.

10. No warranties — the honest version

Planium is provided "as is" and "as available". As a one-person project, I cannot promise that the service will always be available, error-free, or that data will never be lost — although backups are made. I may change, pause, or discontinue features at any time.

This does not limit your statutory rights. Nothing in these terms excludes or limits any right or warranty that you are entitled to under mandatory EU or Dutch consumer law.

11. Liability

To the extent permitted by law, I am not liable for indirect damage (such as missed appointments, lost profits, or data loss caused by circumstances outside my control) arising from the use of, or inability to use, Planium.

Nothing in these terms excludes or limits liability for intent (opzet) or gross negligence (bewuste roekeloosheid), for death or personal injury caused by negligence, or for anything else that cannot be excluded under Dutch or EU law.

12. Third-party services and content

Planium can hand you off to third-party apps and websites at your request — for example opening an address in Google Maps or Apple Maps, adding an activity to Google Calendar, or opening a link that someone attached to an activity or typed in a chat. Those services have their own terms and privacy policies, I do not control them, and I am not responsible for them or for what you find there.

Many of Planium's icons are based on the open-source Lucide icon set, and the iPhone app is built on the open-source Capacitor shell. Both are used under their licences, which are reproduced in the third-party licences document.

13. If you got Planium from the App Store

These terms are between you and me, not with Apple. Apple has no obligation to provide maintenance or support for Planium and is not responsible for the app, its content, or any claims relating to it — including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation. Apple is not responsible for addressing any claim that the app infringes a third party's intellectual property rights. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not located in a country subject to a US government embargo and are not on any US government restricted-party list, and that you will comply with any third-party terms that apply to your use of the app.

14. Changes to these terms

If these terms change in a meaningful way, you will be notified in the app and by email at least 30 days before the changes take effect (except for changes required by law or urgent security reasons, which may take effect sooner). If you don't agree with the new terms, you can delete your account before they take effect. Continuing to use Planium after that date means you accept the updated terms.

15. Governing law

These terms are governed by Dutch law. If you live in another EU country, you always keep the protection of the mandatory consumer laws of your own country, and you may bring disputes before the courts of your own country of residence.
